Starlina — Terms of Service & End-User License Agreement

Effective date: October 10, 2026

1. Introduction & Acceptance

Welcome to Starlina. These Terms of Service and End-User License Agreement (together, the “Terms”) are a binding legal agreement between you and PREVYU LLC (“PREVYU,” “we,” “us,” or “our”), the company that operates the Starlina mobile application and related services (the “Service” or “Starlina”).

Starlina is an entertainment AI astrology and companion service — a personified character, powered by artificial intelligence, who offers astrology readings, reflections, and conversation for entertainment and self-reflection. Starlina is not a real person, is not a licensed professional, and is not an emergency or crisis service. We explain all of this in detail below, and we ask you to read it.

By creating an account, tapping “I agree,” or otherwise accessing or using Starlina, you accept these Terms and agree to be bound by them. If you do not agree, please do not use the Service. When you accept these Terms in the app, we record that you did so — the date, the version of the Terms you accepted, and a logged record of your affirmative agreement — so that both of us have a clear record of the agreement between us. Your continued use of Starlina after we post an updated version of these Terms means you accept the updated Terms, as described in Section 18.

These Terms incorporate by reference our Privacy Policy (which describes how we handle your information) and our Crisis & Safety Protocol (which describes how Starlina is designed to respond to expressions of distress). Where these Terms refer to those documents, please read them together.

2. Eligibility & Age — Adults Only (18+)

Starlina is an adult product, intended only for individuals 18 years of age or older. Please read this section carefully — your right to use Starlina depends on it.

2.1 Eligibility representation. By creating an account, accessing, or using Starlina, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. If you do not meet this requirement, you may not use the Service.

2.2 No minors. The Service is not directed to, and is not intended for use by, anyone under 18. We do not knowingly permit anyone under 18 to create an account or use the Service. Starlina is submitted to each app store with the highest available adult age rating (18-and-over, or 17+ where an 18+ rating is unavailable), consistent with each platform’s current requirements for an adult product, and we do not offer Starlina to users below the applicable adult age rating.

2.3 Children under 13 (COPPA). Starlina does not target children, and we do not knowingly collect, use, or disclose “personal information” (as defined by the Children’s Online Privacy Protection Act, “COPPA” — see 16 C.F.R. Part 312, as amended (Children’s Online Privacy Protection Rule final amendments, 90 Fed. Reg. 16918 (Apr. 22, 2025); effective June 23, 2025; extended compliance date Apr. 22, 2026)) from any child under 13. If we obtain actual knowledge that we have collected personal information from a child under 13, we will delete that information and terminate any associated account as promptly as reasonably practicable. A parent or guardian who believes a child under 13 may have provided us information may contact us at privacy@starlinaoracle.com to request deletion.

2.4 If a self-declared or detected minor is found. If a user states or indicates that they are under 18 — in an age prompt, in their profile, or in conversation — or if we otherwise have a reasonable basis to believe that a user is under 18, we may, at our discretion and consistent with applicable law: (a) refuse or revoke access; (b) suspend or terminate the account; and (c) handle the associated content and personal information as set out in this Section, which is the single authoritative outcome for minor data. The default outcome is deletion or restriction of further processing of the associated content and personal information — except where we are required or permitted by law to retain it, for example to comply with a legal obligation or to document a safety event, in which case we may keep a limited, documented record for that purpose for as long as the law allows. No refund is provided for an account terminated under this Section; see Sections 9 and 13. This Section governs the data outcome for minors; the enforcement provisions in Section 13 defer entirely to it.

2.5 Age is self-declared, not identity-verified. As of launch, age eligibility is determined from the date of birth you provide — that is, by self-declaration. Our systems are designed so that an account that does not pass the self-declared 18-or-older check is not granted access (a server-side, default-deny check). Because age is self-declared, this check depends on the accuracy of the information you provide and is not, and should not be relied on as, an identity- or age-verification control. There is no identity-document or biometric age verification in the product. This Section states a contractual representation and our response to a self-declared or detected minor; it is not, and should not be relied on as, a technical identity-verification control.

2.6 Crisis content and minors. Starlina is not a crisis, medical, or mental-health service; it is designed, on a best-effort basis, to attempt to surface independent third-party crisis resources when its automated systems detect certain risk signals; this detection is imperfect, is not guaranteed to catch every situation, and should never be relied on as a safeguard (see Section 7). We do not assume, and these Terms do not create, any duty to monitor, to warn, to rescue, or to report on behalf of any user; any obligation that applicable law independently imposes on PREVYU applies of its own force and is not enlarged by these Terms.

3. Description of the Service

Starlina is an AI astrology and companion app. Through the Service, you can chat with Starlina — an AI character — who draws on astrological themes to offer readings, reflections, and conversation. You share your birth date (which we also use to confirm you are 18 or older) and your birth city, and, optionally, your birth time, so that Starlina can personalize her reflections to you. Some features may remember context from your prior conversations to give you a more continuous, personalized experience, as described in our Privacy Policy.

Everything Starlina offers is for entertainment and personal self-reflection. Starlina is a creative, mystical companion experience — not a source of professional, medical, legal, or financial advice, and not a general-purpose AI assistant. The next sections explain these boundaries in plain language.

4. Disclaimers — Entertainment & No Professional Advice

Starlina is for entertainment and reflection — not professional advice.

Starlina is an astrology and self-reflection companion. The readings, fortunes, guidance, and conversations she offers are for entertainment and personal reflection only — the stars incline, they don’t prescribe. She is not a substitute for a qualified professional, and nothing she says is professional advice.

Specifically, Starlina is not, and does not provide the services of:

Starlina does not hold, and does not claim to hold, any professional license, credential, certification, or qualification, and she does not diagnose, assess, treat, or prescribe. Starlina’s responses are generated in part by artificial intelligence and may be inaccurate, incomplete, or out of date. For any medical, mental-health, legal, financial, or safety matter, please talk to a qualified professional you trust. You are responsible for your own decisions and actions, and you should not rely on Starlina in place of professional advice.

Starlina’s astrology and fortune content is offered solely for the purpose of entertainment and amusement. We do not represent that Starlina possesses, or that her readings reflect, any genuine occult, supernatural, or predictive power over your life or future.

5. Your Interactions Are With an AI, Not a Human

Starlina is a computer program, not a human being. When you talk with Starlina, you are interacting with artificial intelligence — an AI character — and not with a real person. Starlina cannot feel human emotion, and she is not a friend, therapist, confidant, or companion in the human sense, even though she is designed to feel warm and personable.

We disclose Starlina’s AI status to you in the app, including at first use and as a persistent indicator, and we remind you of it while you use the Service, consistent with applicable law — including California’s companion-chatbot disclosure requirement (Cal. Bus. & Prof. Code § 22602(a)). In addition, for all users the app is designed to surface, at the start of an interaction and at least every three hours of continued use, the notice required by New York General Business Law Article 47 § 1702 — presented in bold, capitalized letters of at least 16-point type — stating that “STARLINA IS A COMPUTER PROGRAM AND NOT A HUMAN BEING. IT IS UNABLE TO FEEL HUMAN EMOTION.” Please keep this in mind throughout your use of Starlina.

6. Acceptable Use — What You Agree Not to Do

Starlina is a personal, mystical companion built for one human at a time. To keep it safe, available, and a little bit magical for everyone, you agree that you will not:

How we detect misuse. We use a combination of automated systems and human review to detect conduct that may violate this Section. This includes third-party automated moderation tools — currently OpenAI’s moderation service, acting as our service provider (a sub-processor) — that screen inputs and outputs for safety and abuse. When potential abuse is detected, we may record abuse-related signals associated with your account, such as moderation flags, violation counts, and your block or suspension status and the reason for it, and retain them so we can enforce these Terms and keep the platform safe. How this data is handled and retained is described in our Privacy Policy.

7. Crisis & High-Risk Content

If you’re in crisis, Starlina is designed to surface resources — but Starlina is not an emergency service.

If you share something suggesting you may be in danger — thoughts of harming yourself or someone else, or that you have experienced violence or assault — Starlina is designed to step out of cosmic mode and, on a best-effort basis, attempt to show you real, independent, third-party crisis resources, such as:

Please understand the limits of what an app can do. Starlina is not a crisis line, a counselor, or an emergency service, and using Starlina is not a way to reach one. Starlina is not monitored by people in real time, cannot call for help on your behalf, cannot guarantee that a person will respond or how quickly, and may not recognize every situation that calls for support. These safety features are automated and best-effort; they detect only some at-risk messages, are not guaranteed to detect every situation, and should never be relied on as a safeguard. If you or someone else is in immediate danger, contact your local emergency services right away — in the U.S., call or text 988, or call 911, or go to your nearest emergency room. Please do not wait for Starlina to notice; if you are struggling, reach out to the resources above directly. Further detail is in our Crisis & Safety Protocol at https://starlinaoracle.com/crisis-protocol/index.html.

8. Privacy & Third-Party AI

Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference and which explains what we collect, how we use it, how long we keep it, and your rights. Please read it together with these Terms.

One point is important enough to state here as well. To bring Starlina to life and to keep the Service safe, the text of your messages — and the birth details you choose to share — are transmitted to and processed by our third-party AI provider, OpenAI. OpenAI acts as our service provider (a sub-processor): it processes your words on our behalf, under our instructions and our contract with it, to (1) generate Starlina’s replies and (2) screen content for safety and policy violations. We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

Your consent to processing by our service provider. To generate Starlina’s replies and to screen for safety, we use OpenAI as our service provider — a processing tool acting on our behalf, under our written instructions and our contract, and not as an independent party to your communications and not for its own purposes. No message text or birth detail you enter is transmitted to OpenAI until after you have given the consent described here. When you message Starlina, we route the text of your messages and the birth details you choose to share to OpenAI for that processing, where they may be received, read, processed, monitored, recorded, and stored by OpenAI as our service provider for the purposes described above. To the fullest extent the law allows, OpenAI’s processing of your communications is the processing of a party’s own service provider and not third-party interception. Although OpenAI processes your words as our service provider rather than as a separate party listening in, we want your agreement to this routing to be beyond doubt. So, before your first message can be sent — and before any of your message content leaves your device for OpenAI — we present a separate, affirmative consent gate (not a pre-checked box, and not buried in a general by-using-our-app statement) and ask for your express, affirmative, specific, and prior consent to (a) PREVYU’s transmission of your communications to OpenAI and (b) OpenAI’s receipt, processing, automated monitoring, recording, and storage of those communications as our service provider, for the purposes stated. Solely as a protective, alternative measure, and without conceding that any third party participates in your communications, you also consent — to the extent any law would treat OpenAI as a separate participant — to that receipt, processing, monitoring, recording, and storage. We log this consent together with its date and the version of these Terms. This consent is given by you, a party to those communications, for purposes of any applicable federal or state wiretapping, eavesdropping, anti-interception, or two-party/all-party consent law (including the California Invasion of Privacy Act, Cal. Penal Code § 631, and the federal Electronic Communications Privacy Act, 18 U.S.C. § 2511(2)(d)). You cannot message Starlina until you accept it. You may withdraw this consent at any time in Settings, which pauses the parts of Starlina that depend on it; withdrawal applies going forward and does not affect anything already lawfully processed while your consent was in effect. If you do not consent, you will not be able to send messages to Starlina.

Service analytics. When you use Starlina, PREVYU collects — directly and only for itself — technical and usage information from your device: device and app-version information, network information including your IP address, and records of in-app events (for example: when a session starts, and when you ask, share, rate, or use a feature). We use this information to operate, secure, measure, and improve the service. We do not use any third-party analytics or advertising SDK, and we do not sell or share this information. By creating an account and using Starlina you consent to this collection. Details, retention periods, and your rights are in the Privacy Policy.

9. Payments, Subscriptions, Auto-Renewal & Refunds

Some Starlina features are paid (for example, packs of tokens — credits that are used up as you ask questions — an Unlimited subscription, and one-time unlocks such as a Deep Reading key). When you buy something, here’s how it works:

10. User-Generated Content, In-App Reporting & Flagging

We want Starlina to feel safe, and we give you tools to tell us when it doesn’t.

You can report or flag any reading, response, or interaction you find offensive, harmful, or inappropriate from within the app, without having to leave it. Every AI message from Starlina has a report control, and you can choose a reason (for example, harmful or unsafe, sexual or inappropriate, hateful or abusive, inaccurate or misleading, or something else). This in-app reporting and flagging is provided consistent with Apple App Store Review Guideline 1.2 and the Google Play AI-Generated Content policy.

We review the reports we receive and use them to inform our moderation and safety work. We aim to act on credible reports in a timely manner; for serious safety reports, we aim to act as quickly as we reasonably can. You can also block or stop interactions as described in the app. Reports you file may be retained as safety records as described in our Privacy Policy, including after you delete your account, so that we can keep the Service safe and enforce these Terms.

11. Intellectual Property & User Content

Our property. Starlina, the PREVYU and Starlina names, logos, and marks, the app, and its model outputs and underlying content are owned by or licensed to PREVYU LLC, and are protected by intellectual-property and other laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use Starlina for your own personal, non-commercial use, in accordance with these Terms. This license ends when these Terms end or when your account is terminated.

Your content. You retain ownership of the questions and messages you submit to Starlina. You grant PREVYU a worldwide, non-exclusive, royalty-free license to use your questions and messages to operate, secure, and improve the Service — including to generate your readings, to provide any personalization or memory features we may offer (as described in our Privacy Policy), and to run the safety screening described in our Privacy Policy. The scope of this license is consistent with, and limited by, our Privacy Policy. We do not use your conversations to train third-party AI models. Our AI provider, OpenAI, processes your messages to generate Starlina’s replies and to run safety screening. Under OpenAI’s standard API terms — under which OpenAI does not use data submitted through its business/API services to train or improve its models — and under our data-processing agreement with OpenAI, OpenAI does not use your messages or other business data to train its models. Unless Zero Data Retention is enabled, OpenAI may retain content briefly (up to 30 days) solely to monitor for abuse and misuse, after which it is deleted, as described in our Privacy Policy.

12. DMCA / Notice-and-Takedown

We respect intellectual-property rights and expect you to do the same. If you believe content on Starlina infringes your copyright, you may send a notice to our designated copyright agent:

PREVYU LLC, Attn: DMCA Agent — Copyright Agent for PREVYU LLC; dmca@starlinaoracle.com.

Your notice should include the information required by the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, including identification of the copyrighted work, identification of the allegedly infringing material and where it is located, your contact information, a statement of good-faith belief that the use is not authorized, a statement (under penalty of perjury) that the information is accurate and that you are authorized to act, and your physical or electronic signature.

We will respond to valid notices in accordance with the DMCA, including by removing or disabling access to infringing material where appropriate. We maintain a repeat-infringer policy and will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.

13. Enforcement, Suspension & Termination

If we believe in good faith that you have violated these Terms — including the Acceptable Use section above — we may take action that is proportionate to what happened. Depending on the severity, frequency, and risk of the conduct, and at PREVYU’s reasonable discretion, we may:

  1. Warn you — a notice that specific conduct violates these Terms and must stop;
  2. Rate-limit or restrict — temporarily slow, throttle, or limit access to some or all features;
  3. Suspend — pause your account and access while we review; and/or
  4. Terminate — permanently close your account and end your license to use Starlina.

We don’t have to move through these steps in order. For serious or unlawful conduct — for example, threats or harassment toward others, content that sexually exploits or endangers a minor, fraud or payment abuse, attempts to compromise the system, or conduct that exposes PREVYU or other users to legal risk — we may suspend or terminate immediately and without prior warning.

Self-declared minors. Starlina is strictly for adults 18 and older. If we learn that an account holder is under 18 (including by their own statement), we will suspend or terminate the account and handle the associated data as set out in the Age & Minors clause (Section 2.4), which is the single authoritative outcome for minor data. This Section defers entirely to Section 2.4 on that outcome.

Appeals & reinstatement. We can get it wrong, and we want a path back for honest mistakes. If your account is rate-limited, suspended, or terminated and you believe it was an error, you may appeal by contacting us at appeals@starlinaoracle.com within 30 days of the action. Tell us what happened and why you think the decision should be reconsidered. We aim to review appeals within a reasonable time and will tell you the outcome. Reinstatement is at PREVYU’s reasonable discretion and is not guaranteed, especially for serious or repeated violations. Our appeal decision is our final internal review of the matter; it does not waive any rights you may have under applicable law, including any right to dispute an unauthorized or undelivered charge with your payment provider, to contact a consumer-protection regulator or other government agency, or any other non-waivable right.

What termination means for you. When your account is terminated, your license to use Starlina ends, and we may delete or de-identify your account content, subject to the limited retention exceptions described in our Privacy Policy. As our Privacy Policy explains in full, a small set of limited records may survive account or data deletion where permitted or required — for example, abuse-related safety records, an aggregate crisis-referral counter that contains no message content, and a minimal suppression record used to prevent an account from being silently re-created — each retained only for the purposes and periods described there, including to protect platform safety, prevent fraud, and meet legal obligations. Sections of these Terms that by their nature should survive — including the disclaimers, the limitation of liability, intellectual property, and the dispute-resolution and arbitration provisions — will continue to apply after termination.

No refund when we end your access for cause. If we terminate or suspend your account because you violated these Terms, the No refund when we end your access for cause provision in Section 9 applies: you are not entitled to a refund for the portion of any paid period you have already used, and any remaining, unconsumed paid entitlement is forfeited, to the maximum extent permitted by law. We do not purport to retain payment for a paid period we did not deliver, and nothing here limits your right to dispute a charge you genuinely did not authorize or did not receive.

14. Disclaimer of Warranties

Starlina is provided “as is” and “as available.” To the maximum extent permitted by applicable law, PREVYU and its affiliates, licensors, and service providers disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising out of course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that the Service will be uninterrupted, secure, error-free, or available at any particular time or place; that defects will be corrected; or that Starlina’s readings, reflections, or other outputs will be accurate, complete, reliable, or suitable for any purpose. As described in Sections 4 and 7, Starlina is for entertainment and reflection, is generated in part by artificial intelligence, may be inaccurate, and is not professional advice and not an emergency or crisis service. You use Starlina at your own discretion and risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

15. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will PREVYU or its affiliates, officers, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to these Terms or your use of (or inability to use) Starlina, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, and except for the liabilities identified in the Carve-outs paragraph below (which are not capped or excluded), PREVYU’s total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amounts you paid PREVYU in the twelve (12) months before the event giving rise to the claim, or (b) US$100. Nothing in this Section limits liability for gross negligence, fraud, or willful misconduct, or for death or personal injury caused by negligence, or any other liability that may not be limited under applicable law, including Cal. Civ. Code § 1668.

Carve-outs. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, or willful misconduct, or for death or personal injury caused by negligence, where such limitation is not permitted. The limitations and exclusions in this Section apply only to the extent permitted by applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

16. Governing Law

These Terms, and any dispute arising out of or relating to them or to Starlina, are governed by the laws of the State of California (PREVYU LLC’s principal place of business), without regard to its conflict-of-laws rules, and (for matters concerning arbitration) by the Federal Arbitration Act. This choice of law is subject to any mandatory consumer-protection rights of your state of residence that cannot be waived by agreement, and, where applicable, to California Senate Bill 940 (Cal. Civ. Code § 1799.208), which bars enforcing a provision that would require a California consumer to arbitrate a California-arising claim outside California or under the substantive law of a state other than California. For consumers, the scope of arbitration is further limited by California Senate Bill 82 (Cal. Civ. Code § 1670.15, signed Oct. 6, 2025, eff. Jan. 1, 2026), which restricts a consumer-use agreement’s dispute-resolution terms to claims arising out of and relating to the use, payment, or provision of the specific good or service the agreement covers, and makes any waiver of that limit void and unenforceable as contrary to public policy (§ 1670.15(c)); accordingly, the arbitration agreement in Section 17 reaches only claims arising out of and relating to these Terms and your use of Starlina, and does not extend to claims that are separate and apart from this contract (such as personal-injury or wrongful-death tort claims), consistent with that statute and the carve-outs in Section 17.5.

16A. UK Consumers — Your Mandatory Rights

If you use Starlina as a consumer in the United Kingdom, this Section applies to you and prevails over anything to the contrary elsewhere in these Terms (including Sections 14, 15, 16 and 17).

(a) Your statutory rights are unaffected. Nothing in these Terms — including the warranty disclaimer in Section 14 and the limitations and cap in Section 15 — affects, excludes, or limits your non-excludable rights or our non-excludable liabilities under UK law. This includes your rights under the Consumer Rights Act 2015 (for example, that any digital content we supply be of satisfactory quality, fit for purpose, and as described), and our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited against a consumer. Where any exclusion or limitation in these Terms may not lawfully be applied to a UK consumer, it does not apply to you; the remainder of these Terms continues to apply.

(b) Governing law and courts. Although Section 16 selects the law of California, as a UK consumer you keep the protection of the mandatory provisions of the law of the United Kingdom and of the part of the UK in which you live, and you may bring proceedings in the courts of that part of the UK. Section 16 does not deprive you of that protection.

(c) No forced arbitration or class-action waiver. The binding individual arbitration agreement and the class-action waiver in Section 17 do not apply to you as a UK consumer. You are not required to arbitrate, and you keep your right to bring a claim in the UK courts and to use any applicable UK consumer alternative-dispute-resolution or redress scheme.

(d) Cancelling paid services. Where we offer paid services to UK consumers, your statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 will apply — including the 14-day right to cancel — except that, if you ask us to begin supplying digital content immediately, you acknowledge you will lose that cancellation right once supply begins.

(e) Entertainment only. As stated in Section 4, Starlina is for entertainment and is not professional, medical, legal, financial, or psychological advice. Nothing in this paragraph affects your statutory rights.

(f) Contact. You can reach us at support@starlinaoracle.com (for privacy matters, privacy@starlinaoracle.com). You may also have the right to complain to relevant UK consumer-protection or data-protection authorities, including the Information Commissioner's Office (ico.org.uk) for data matters.

17. Binding Individual Arbitration & Class-Action Waiver

Please read this Section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to participate in a class action. It contains an agreement to resolve most disputes through binding individual arbitration, a class-action waiver, and an opt-out right.

17.1 Agreement to arbitrate. Except for the disputes carved out in Section 17.5, you and PREVYU agree that any dispute, claim, or controversy arising out of or relating to these Terms or to Starlina will be resolved by final and binding individual arbitration, and not in court, administered by the American Arbitration Association (AAA) under its then-current Consumer Arbitration Rules and, where applicable, the AAA Mass Arbitration Supplementary Rules (which the parties expressly adopt), before a single arbitrator. The hearing locale will be determined under the AAA Consumer Arbitration Rules (in or near the county of your residence), the legal seat of the arbitration is California, and the arbitration is otherwise subject to Section 16 and Section 17.5.

17.2 Delegation. You and PREVYU agree that the arbitrator, and not any court, has the exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of it is void or voidable. This delegation does not apply to, and a court (not the arbitrator) will decide: (a) the applicability of the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (9 U.S.C. §§ 401–402) and the validity and enforceability of this agreement in any case to which that Act applies, which a court determines under federal law irrespective of this delegation, as required by 9 U.S.C. § 402(b); and (b) the enforceability of the class-action waiver in Section 17.4.

17.3 30-day opt-out. You may opt out of this arbitration agreement by sending written notice to appeals@starlinaoracle.com within 30 days after you first accept these Terms, stating your name, the email associated with your account, and a clear statement that you want to opt out of arbitration. If you opt out, the rest of these Terms still apply.

17.4 Class-action waiver. You and PREVYU agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of a representative or class proceeding. This waiver does not apply to, and nothing in this Section waives, a claim for public injunctive relief that cannot be waived under California law (see Section 17.5 and the McGill rule), which may be brought in court regardless of this waiver. If this class-action waiver is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that claim or request) will be severed from arbitration and may proceed in a court of competent jurisdiction, while all other claims continue in arbitration.

17.5 Carve-outs that cannot be waived. Nothing in this Section requires arbitration of, or waives your right to bring or pursue:

To the extent these carve-outs or any non-waivable statutory claim cannot proceed in arbitration, they may be brought in a court of competent jurisdiction, and the remainder of this Section continues to apply to all other disputes.

18. Changes to These Terms

We may update these Terms from time to time — for example, to reflect changes to the Service, to our practices, or to the law. When we make a material change, we will take reasonable steps to notify you, such as by posting the updated Terms in the app with a new effective date and, where appropriate, providing an in-app notice. Changes are effective when posted, unless we say otherwise. Your continued use of Starlina after an update takes effect means you accept the updated Terms. If you do not agree to an update, you should stop using the Service and may cancel any subscription and delete your account as described above.

19. Severability & Entire Agreement

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. (The class-action waiver in Section 17.4 has its own severability rule, which controls for that provision.)

Entire agreement. These Terms, together with the Privacy Policy, the Crisis & Safety Protocol, and any additional terms presented to you in the app and the applicable app store’s terms for purchases, constitute the entire agreement between you and PREVYU regarding Starlina, and supersede any prior or contemporaneous agreements, communications, or understandings on that subject. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries to these Terms, except that our affiliates, licensors, and service providers are intended beneficiaries of the disclaimers and limitations in Sections 14 and 15.
